Who we are

The Website is a Software-as-a-Service (SaaS) product designed to assist students with their thesis projects. Pontbot is provided and operated by Pandai Tech Ltd, a company incorporated in England with company number 14430212 and whose registered office is at Hova House, 1 Hova Villas, Brighton & Hove, BN3 3DH ("we" or "us" or "our"). Our trading name is Pandai Tech Ltd. The term the "Website" refers to the website at pontbot.hu and pontbot.com. These terms of use also apply to the mobile and tablet versions of the Website and our app.

Acceptance of Terms and conditions

By accessing this website, you accept these terms and conditions. Please do not use our Website if you do not accept these terms. We recommend that you keep a copy of these terms for future reference. If you are registering on behalf of a business entity, you represent that you have the authority to bind that business entity to the terms and conditions set forth herein.

Update

These terms and conditions govern your use of the Website and may be amended from time to time with new or different terms and conditions. We therefore recommend that you review these terms and conditions regularly.

Website use

You may not use the Website:

• in any way that breaches any applicable local, national or international law or regulation relating to privacy, data protection, intellectual property or defamation;
• to transmit, or procure the sending of, any material that contains software viruses or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

• for the purpose of introducing into our Website trojans, viruses, worms, logic bombs, keystroke loggers, spyware, adware or other material designed to adversely affect the operation of any computer software or hardware;
• for the purpose of manipulating any Internet protocols in order to disguise the origin of any transmission;
• for the purpose of extracting personal information from any user without their prior written consent;
• in a way that could result in a denial-of-service attack on our Website;
• in any way that is otherwise unlawful or otherwise breaches applicable laws;
• to use the Website to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

Registration Obligations

By registering for and using the Website you represent and warrant that:

• you have reached the age of legal majority;
• there is nothing to prevent you from receiving the services provided on or via the Website;
• you have the legal capacity to enter into binding contracts;
• you are aware of the restrictions on the use of the Website for illegal activities;
• you are able to comply with and will observe these terms and conditions;
• you have all the rights and authority to provide any and all information submitted to the Website;
• all information you submit is true, accurate, current and complete.

Website access arrangements and security

You are responsible for making all arrangements necessary for you to have access to the Website. You should also ensure that anyone who accesses the Website through your internet connection is aware of and complies with these terms of use.

If you register with us, you must treat your user name, password, and any other information that forms part of our security procedures as confidential. You must not disclose it to any third party. You agree to notify us immediately of any unauthorized use of your user name, password or other credentials, or any other breach of security. Pandai Tech Ltd will not be liable for any losses caused by any unauthorized use of your account and you may be liable for any losses of Pandai Tech Ltd or others due to such unauthorized use.

You may not sell, transfer or share access information or access rights to any third party. You agree to keep your customer information truthful, current and accurate and to promptly notify us of any changes to such information.

Our Remedies

We have the right, without notice and without liability, to suspend, restrict, or terminate your access to the Website and disable any user identification code, password or other identifier, whether chosen by you or allocated by us. We are not obliged to notify any third party of any termination of access to the Website.

Subscribing for membership

Pontbot Premium is a monthly, paid-for subscription service for Pontbot customers and companies.

Monthly subscription

Your subscription will be renewed automatically each month on the anniversary of your Purchase Date, at the then-current rate, until you cancel your subscription. You will NOT receive an email notification every month before your monthly subscription ends.

Current Fee

All current prices for subscribing to the Website are available on the subscription page on our Website. By using the Member services you agree to pay the applicable subscription fees.

Payment methods of the Fee

Payment can be made using a credit card, debit card, or by direct debit. The Pandai Tech Ltd does not store your credit card details, this is done exclusively by Stripe. By submitting your card and payment details, you represent and warrant that you are authorized to use the card or bank account used by you. Premium access to Member services only begins once we have received payment of the Fee.

Member services are for the exclusive use of members and their authorised staff for the purpose of their subscription related activities.

Limitations

As a member, you will not sell, license or otherwise commercially exploit any of the Member services. If you are found to be sharing your account with another user, we may immediately terminate the service. If payment is not received, then Pandai Tech Ltd can terminate any membership and any outstanding fees become due immediately. We reserve the right to reject any membership applications without giving a reason.

Fair Usage Policy

Although we may market services as "unlimited", all subscriptions are governed by a fair use policy. This means that there will be a reasonable maximum limit that is consistent with typical use patterns. This is to prevent unfair usage patterns and to maintain the sustainability of our service. By subscribing to our service, you acknowledge and agree to abide by this fair use policy.

Cancellation

You can cancel your membership by email or by using the Profile menu. You will receive confirmation if you cancel by email. The renewal date for your monthly subscription is shown in your purchase confirmation email and on your invoices. If you fail to cancel your subscription before the renewal date you will automatically be subscribed for the following month at the then current price.

Right to refund

We sell digital products and hence there is no legal requirement for any refund, just as there is no requirement for return rights (such as with the usual 14 days). When you buy a product you are paying for a license, not ownership. We are sorry, we do not offer a refund, but you can cancel the subscription before the start of the next subscription period. If you forgot to cancel before the next period, you are still not entitled to a refund.

Disclaimer

The information contained in this Website is for general information purposes only. The information is provided by Pontbot and while we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the security, accuracy, completeness, suitability, freedom from bugs and viruses or availability with respect to the Website or the information, products, services, or related graphics contained on the Website for any purpose.

We're not liable for any loss or damage that may come from using our website. This includes any kind of loss or damage, whether direct, indirect, or consequential, any civil wrong like negligence, any contract breach, any loss connected to another website linked to ours, or any loss caused by not being able to access our website or our services. This applies whether or not we knew the damage could happen.

This includes, but is not limited to, lost income or revenue, lost salaries or wages, lost business, lost profits, loss of anticipated or expected contracts, loss of goodwill, loss of reputation, wasted time of management or other staff, loss of opportunity, any wasted savings you expected to have, lost data, damage to tangible property, and damage to any intangible property including any computer system.

WE MAKE NO REPRESENTATIONS CONCERNING ANY CONTENT ACCESSED THROUGH OR CONTAINED IN THE SERVICES.

Indemnity

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD Pandai Tech Ltd AND ITS AFFILIATES AND RELATED ENTITIES, AND ITS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES, HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, LIABILITIES, COSTS, EXPENSES, OR DEMAND, INCLUDING ATTORNEYS' FEES, ARISING FROM OR RELATING TO: (I) ANY CONTENT YOU POST OR OTHERWISE TRANSMIT THROUGH THE SERVICES; (II) ANY INFORMATION OR MATERIALS FROM CONTENT PROVIDERS OF YOUR CHOOSING THAT YOU ACCESS, VIEW, READ OR OTHERWISE DOWNLOAD FROM THE SERVICES; (III) YOUR CONNECTION TO AND USE OF THE SERVICES; (IV) YOUR BREACH OR VIOLATION OF ANY OF THESE TERMS AND CONDITIONS; (V) ANY FRAUD OR INTENTIONAL MISCONDUCT ON YOUR PART; AND/OR (VI) YOUR VIOLATION OF ANY RIGHTS OF ANY THIRD PARTY.

Your indemnification obligations hereunder shall survive the termination of these Terms. You will be solely responsible for your interactions with other users. Pontbot is hereby released by you from any and all claims, demands, damages (actual and consequential) of every kind and nature, known and unknown, arising out of or relating to (a) any products or services sold or offered by you or by any third party, and/or (b) any speech, act, conduct, website posting or other content by you or by any third party.

Requests to remove content

You can ask us to remove content on Pontbot about you. We can remove content that:

• falls within data protection legislation
• falls within copyright legislation
• contains sensitive personal data
• could be potentially obscene or defamatory

Please contact us to request any such removal.

Information about you and your visits to Pontbot

We collect information about you in accordance with our privacy policy. By using our Website, you agree to such collection and confirm that any data you provide is accurate.

General

Please also see any additional legal notices that may be published from time to time on specific parts of our Website. A party to this agreement who fails to comply with these terms due to circumstances which cannot reasonably be expected to be under their control shall not be liable for such failure. No failure by either party to exercise any power or enforce their rights under these terms and conditions shall operate as a waiver of those rights or powers, nor shall any failure by either party to enforce its rights on one occasion preclude it from doing so at a later date. If any part of these terms and conditions is deemed illegal, invalid or otherwise unenforceable by a court then that part shall be severed from the rest of these terms without affecting the rest of the terms and conditions.

Access to the Website may be restricted partially or wholly. We reserve the right to change these terms, conditions and any disclaimers from time to time. You are advised to check these terms and conditions regularly as changes made by us are binding on you. The continued use of our website or our services after any changes to the agreement shall constitute your acceptance. Your statutory rights as a consumer are not affected by these terms.
